Transparency International Romania organized on April 29th, 2010, the public debate dedicated to "Public Policy to Ensure Continuity of the National Integrity Agency".
The establishment of the National Integrity Agency was an essential moment in Romania's efforts to fight corruption, covering an institutional and normative vacuum in the application of the law on conflicts of interest, incompatibility and wealth control.
Today, almost 3 years after the adoption of Law no. 144/2007, the experiences that marked the existence of the Agency, but especially the effects of the Constitutional Court's Decision of April 14, 2010 call for the formulation of a new public policy in the field, which unequivocally responds to the need to ensure a centralized mechanism aimed at securing the decision-making process in the public space, as well as providing sufficient guarantees of respect for human rights.
Transparency International Romania underlined in this debate the three solutions it proposes (prezentare TI-RO):
- The unequivocal establishment of a regime of public law in the matter of the conditions for the exercise of public functions and dignities, which, subject to the principle of proportionality, may expressly and legally limit certain rights and freedoms.
- The regulation in this respect of a clearer regime regarding the declaration of assets and interests, as well as of the concrete incompatibilities prohibiting other sources of income than the salary / indemnity, in order to achieve the ratio of compliance with the provisions of art. Article 44 (9) of the Constitution.
- Establish explicit, concrete and detailed provisions to ensure that the institution will no longer (deletion) escape from its institutional mission in the sense of violation of non-patrimonial rights of the verified persons.
